3   No hot food shall be prepared or sold at the premises until such time as details of a fume extraction system, which accords with current DEFRA guidance on the control of odour and noise from commercial kitchen exhaust systems, has been submitted to and approved in writing by the local planning authority. The development shall be carried out in accordance with the approved details and be installed by a competent and appropriately qualified person and the approved ventilation and extraction/filtration equipment shall be used at all times when hot food is being prepared and served on the premises.~~Reason: In the interests of the amenity of surrounding users in accordance with the requirements of policy D1 of the Sedgefield Borough Local Plan as amended by Saved and Expired Policies September 2007.

5   The proposed change of use can be appropriately accommodated at the site in terms of mass, scale and design and represents an acceptable town centre use which would not be detrimental to the main shopping function of the town centre, the amenity of surrounding users and would not have any adverse impact upon highway safety in accordance with Saved Policies S1, S2, D1, D2 and D3 of the Sedgefield Borough Local Plan as amended by the Saved and Expired Policies September 2007 and the National Planning Policy Framework.~~~~This decision has been taken having regard to the policies and proposals of the Sedgefield Borough Local Plan as amended by Saved and Expired Policies September 2007 which is a saved plan in accordance with the Secretary of States Direction under paragraph 1 (3) of Schedule 8 to the Planning and Compulsory Purchase Act 2004. ~~~~In particular the development was considered acceptable having regard to consideration to the issue of the principle of development, impact upon the appearance of the surrounding area, adjoining users and highways safety.~~ 
6   The Local Planning Authority has worked with the applicant in a positive and proactive manner, discussing the proposals prior to submission in an attempt to ensure expedient determination of the application within the statutory period.
